For the designation of positions involving confidentiality in the civil aviation sector the framework is primarily determined by the standard from the EU Regulation 2015/1998 which the European member states have to implement to protect the civil aviation sector against attacks and other acts of terror.

The positions involving confidentiality in the civil aviation sector were designated by the decision of 30 October 2025. The Minister of Justice and Security is the responsible expert minister. This expert minister has assigned the NCTV with the actual execution of tasks and responsibilities. The NCTV is also responsible for the compliance of the Netherlands with the European implementing regulation.

The decision ‘Order background checks Civil Aviation 2025’ has to be evaluated every five years. This evaluation can also take place earlier if necessary, as a consequence of changes in laws and legislation or other relevant events, such as the opening or closing of an airport.

The decision ‘Order background checks Civil Aviation 2025’ is divided into three attachments:

  1. The first attachment describes the designation of positions involving confidentiality at Dutch airports and Dutch airline companies;
  2. The second attachment describes the designation of positions involving confidentiality within the freight and supply chain.
  3. The third attachment describes the designation of the position involving confidentiality instructors security civil aviation.

The employer receives the relevant attachment(s) from the NCTV. These attachment(s) state the reasoning for all positions involving confidentiality as to why they were designated as such.
