Because of the implementation of the amendment of the Police Act 2012 and the Order screening officials of the police and external police employees (hereinafter: the order), since 1 January 2023 the National Police has its own instruments for the screening of (external) personnel which carries out work for the police organisation. This ensures that the National Police can more carefully assess the type of work against the type of security screening that is required.

The designation of positions involving confidentiality can take place only after each reasonable physical and organisational security measure has been implemented, where residual risks continue to exists which can harm the national security. Only for these positions does the Security Screening Act (Wet veiligheidsonderzoeken, Wvo) offer the Minister of Justice and Security the possibility to designate positions at the National Police as positions involving confidentiality.

Also the Special Investigation Services (Bijzondere Opsporingsdiensten, BOD) such as the FIOD, ILT-IOD, NVWA-IOD and the Labour Inspectorate) have positions which can harm the national security, as a result of which it is possible to designate positions involving confidentiality within a BOD. For this purpose BOD should turn to the responsible expert minister and follow the established process for the designation of positions involving confidentiality. It is important here that the designation is paired with clear motivation as to why the official could compromise the national security from this specific position.
